NOVITA AI ACCEPTABLE USE POLICY

Effective Date: August 5, 2026

1. OVERVIEW

This Acceptable Use Policy ("AUP") describes the standards that apply to your use of the websites (https://novita.ai/), APIs, models, and related services (collectively, the "Services") provided by Novita AI ("Novita AI", "we", "us", or "our"). This AUP is incorporated into and forms part of Novita AI's Terms of Use. Capitalized terms used but not defined here have the meanings given in the Terms of Use.

We reserve the right to update this AUP at any time by posting the revised version at novita.ai/legal/acceptable-use-policy and updating the effective date. Your continued use of the Services after the updated effective date constitutes your acceptance of the revised AUP. We encourage you to review this AUP periodically. Violation of this AUP may result in immediate suspension or termination of your account and access to the Services.

Note: Certain uses of the Services are absolutely prohibited regardless of the terms of this AUP. Those prohibitions are set forth in Section 9 of the Terms of Use and cannot be modified by updates to this AUP.

2. GENERAL CONDUCT

You may not use the Services in any manner that:

(1) Violates any applicable local, national, or international law or regulation.

(2) Is for any purpose other than your own personal, internal business, or permitted commercial use of the Services.

(3) Involves impersonating another user, person, or entity, or using another user's account credentials without authorization.

(4) Involves providing false, inaccurate, or misleading information to Novita AI or other users.

(5) Involves harassing, threatening, intimidating, or abusing Novita AI's employees, agents, or other users.

(6) Constitutes criminal or tortious activity, including fraud, defamation, or invasion of privacy.

(7) Disparages, tarnishes, or otherwise harms, in Novita AI's reasonable opinion, the reputation or goodwill of Novita AI, its affiliates, or the Services.

3. PLATFORM INTEGRITY

You may not:

(1) Circumvent, disable, or interfere with security-related features of the Services, including features that prevent or restrict the use or copying of any content.

(2) Attempt to bypass any access controls or authentication mechanisms designed to restrict access to the Services or any portion thereof.

(3) Engage in unauthorized framing of or linking to the Site.

(4) Delete, obscure, or alter any copyright, trademark, or other proprietary rights notices appearing on or through the Services.

(5) Copy, adapt, decompile, disassemble, or reverse engineer any software comprising or in any way making up a part of the Services, except as permitted by applicable law.

(6) Sell, transfer, sublicense, or otherwise assign your account or access rights to a third party without Novita AI's prior written consent.

4. AUTOMATED AND PROGRAMMATIC ACCESS

The following uses are not permitted:

(1) Using scripts, bots, crawlers, or other automated tools to scrape, harvest, or systematically extract data from the Site itself or to compile such data into a collection, compilation, database, or directory.

(2) Using any data mining, robots, or similar data gathering and extraction tools against the Site's web interface in a manner that creates an undue burden on Novita AI's infrastructure.

(3) Launching, developing, or distributing any automated system — including spiders or offline readers — that accesses the Site in a manner that sends more requests to the Site's servers in a given period of time than a human can reasonably produce using a conventional browser during the same period.

(4) Using a buying agent or purchasing agent to make purchases on the Site without prior written authorization from Novita AI.

5. CONTENT STANDARDS

You may not submit, upload, transmit, or generate content through the Services that:

(1) Infringes, misappropriates, or violates any third party's intellectual property rights, privacy rights, or other legal rights.

(2) Is defamatory, obscene, or otherwise objectionable under applicable law.

(3) Contains viruses, Trojan horses, worms, logic bombs, or any other malicious or technologically harmful code.

(4) Acts as a passive or active information collection or transmission mechanism, including clear graphics interchange formats ("gifs"), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as "spyware" or "passive collection mechanisms").

(5) Uses the Site or its community features (including support channels, forums, or user profiles) to advertise, promote, or solicit sales of third-party goods or services unrelated to your permitted use of the Services.

(6) Is used as part of any effort to compete with Novita AI or its affiliates, or to assist a third party in doing so, without Novita AI's prior written consent.

(7) Is sexually explicit.

(8) Is used to develop or operate AI systems that engage in practices prohibited under applicable AI regulations, including but not limited to: subliminal manipulation of user behavior; exploitation of vulnerabilities of specific groups; real-time biometric identification of individuals in publicly accessible spaces; or inferring sensitive personal attributes (including race, political opinion, religious belief, or sexual orientation) from biometric data.

6. CRYPTOCURRENCY MINING AND COMPUTE ABUSE

You may not use the Services for:

(1) Any form of cryptocurrency mining, including but not limited to Bitcoin, Ethereum, or any other digital currency or token mining.

(2) Any other activity that constitutes unauthorized use or abuse of Novita AI's computing infrastructure, as determined by Novita AI in its reasonable discretion.

7. SUPPORT AND ACCOUNT ABUSE

You may not:

(1) Make improper use of Novita AI's support services or submit false reports of abuse or misconduct.

(2) Obtain multiple free quotas or trial credits through mass email registration, disposable accounts, or any other method designed to circumvent per-account usage limits.

(3) Engage in any activity that interferes with, disrupts, or creates an undue burden on the Services or the networks or services connected to the Services.

8. ENFORCEMENT

Novita AI reserves the right, in its sole discretion, to investigate any suspected violation of this AUP and to take any action it deems appropriate, including:

(1) Issuing a warning to the user.

(2) Temporarily or permanently suspending or terminating the user's account and access to the Services.

(3) Removing or disabling access to content that violates this AUP.

(4) Reporting the user to appropriate law enforcement or regulatory authorities.

(5) Pursuing civil or criminal legal action.

Novita AI is not obligated to monitor, screen, edit, or control content submitted through the Services, and does not assume any responsibility or liability for content generated or submitted by users. Nothing in this AUP creates an obligation on Novita AI to take any particular enforcement action.

In addition to the foregoing enforcement measures, any violation of this AUP constitutes a breach of Novita AI's Terms of Use and triggers the indemnification obligations set forth in Section 24 of the Terms of Use. You agree to defend, indemnify, and hold Novita AI and its affiliates harmless from and against any loss, damage, liability, claim, or demand — including reasonable attorneys' fees — arising out of or related to your violation of this AUP or any third-party claim resulting therefrom.

Novita AI reserves the right to remove, disable, or delete any content that violates this AUP without prior notice to you. Such removal is an enforcement action and does not constitute a waiver of any other rights or remedies available to Novita AI. Novita AI shall have no liability to you for any loss, corruption, or unavailability of content resulting from enforcement action taken under this AUP.

9. REPORTING VIOLATIONS

If you become aware of any violation of this AUP, please report it to Novita AI at support@novita.ai. Novita AI will investigate all credible reports and take appropriate action.
